How to win your case before you open Court Statement
Lawyers most veterans would agree that while a case is not always won in jury selection, can easily be lost there. This is one of the three most critical moments of each process (the other two are opening statement and cross-examination of first witness), but voir dire usually is relegated to the proverbial top, only to be treated in the last days - or even hours - just before the trial begins.
If you've waited until the weekend FIRST TRY TO PLAN YOUR voir dire, you've waited TOO LONG
The construction of voir dire needs of start weeks before your case comes to trial, after the pre-trial research (which led the research pre-trial, is not it?) And we are starting to prepare your If the head seriously. If you are to wait until Saturday or Sunday before the trial, noting some questions on a pad and then stand up in court on Monday and conduct the voir dire, without the benefit of research or evidence-based profiles, you might be missing out on opportunities to educate jurors and eliminate the most dangerous for you.
THE PURPOSE OF voir dire to determine if it is NOT fair and impartial JURY MAY BE!
Sorry, but there is no such thing as an impartial juror. Every person who comes to school - juror, lawyer, judge, clerk, court reporter, bailiff - involves two things:
1. Life experiences.
2. The attitudes that are the result of those experiences of life.
Thus, the scope of voir dire is to discover the attitudes and experiences, get jurors to talk about them, and then send home the people who have attitudes that are hostile to you and / or your client.
The main purposes of the Voir Dire
Ø Find and close jurors who will be harmful to your case
OR Take the themes of his case in front of jurors
O Find out who are your judges are and what they are saying about the issues, so you have a better idea of how to communicate with them during your case.
Your goals in Voir Dire
Or make them talk!
Or get them to talk about your issues
Or make them speak in their own persons the jury, if they are hostile to your case
IF ONLY ONE THING TO REMEMBER THIS ARTICLE, THIS IS IT
Do you go into the studio without performing the opening statement? So why not spend the time to try the part of the process when it comes to the jury before? If you do not practice your voir dire, why not? If you practice voir dire, did not practice with the people in the room? If you practice with people in the room, these are the laity? If these are lay people in the room, do you ask for their feedback on how this terrible voir made them feel? If you ask for their feedback, do not apply to voir dire went into the studio?
The bottom line, your voir dire - not the opening statement - is when you make your first impression on jurors. Make the most of this opportunity. Practice, refine the voir dire .......
